Excursiv ("us," "we," or "our," as the context requires) provides an online experience discovery and comparison service (the "Services") to travelers, via our websites, and any future applications or platforms we may release (the "Platforms").

Excursiv is not a travel agency, tour operator, or event organizer, and is not responsible for providing, setting, or controlling the prices applicable to any experience, stay, activity, or other travel product which you find and book via our Services ("Third-Party Travel Products"). All such Third-Party Travel Products are provided by independent tour operators, accommodation providers, restaurants, venues, activity operators, or online booking platforms ("Providers") and are subject to the terms and conditions of those Providers.

PLEASE READ THE "DISPUTE RESOLUTION" SECTION CAREFULLY, AS IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING A CLAIM IN COURT.

These Terms

These terms and conditions ("Terms") govern your access to and use of our Services and Platforms, together with our Privacy Policy, Cookie Policy, and Affiliate Disclosure. By accessing or using the Services or Platforms, you confirm that you have read, understood, and agreed to these Terms and those linked policies. If you do not accept all of these Terms, you should not use our Services or Platforms.

We may provide additional services or platforms which could carry different terms and conditions. Where that is the case, you will be clearly notified, and those terms will operate in place of, or together with, these Terms, as appropriate.

We may amend these Terms at any time at our discretion. If we amend these Terms, we will publish the revised version here, and you will be deemed to have accepted the amendments if you continue using the Services or Platforms after the amendments are displayed.

Using our Services

You may only use our Services and Platforms in compliance with applicable laws and for legitimate purposes. In consideration of you agreeing to these Terms, we grant you a non-transferable, non-exclusive license to access and use our Services and Platforms for your own personal, non-commercial purposes, and for no other purpose. This license is granted subject to you agreeing that you will not:

use our Services or Platforms for any purpose that is improper or unlawful, or to post, share, or transmit material that (i) is illegal, harmful, defamatory, offensive, obscene, or otherwise objectionable, (ii) breaches confidence, privacy, or any third party's intellectual property rights, (iii) is posted or transmitted for the purpose of advertising or promoting yourself or a third party without our consent, (iv) is misleading as to your identity or suggests you are sponsored, affiliated, or connected with Excursiv, or (v) you do not have the rights or permissions to make available;
use our Services or Platforms for any commercial purpose, or in any manner that may cause damage to Excursiv or bring Excursiv into disrepute;
disassemble, reverse engineer, or otherwise decompile any software or application contained in or available via our Services or Platforms, except as legally permitted;
copy, distribute, communicate to the public, sell, rent, lend, or otherwise exploit our Services or Platforms, or seek to circumvent any security measure in place to restrict your access to them;
use or interfere with our Services or Platforms in a way that could damage, disable, overburden, impair, or compromise our systems or security, or interfere with other users;
introduce or transmit onto our Services or Platforms any disruptive or malicious code, virus, worm, trojan horse, or engage in a denial-of-service or spam attack; or
remove, alter, or replace any notice of authorship, trademark, business name, logo, or other designation of origin on our Services or Platforms, or attempt to pass off our Services or Platforms as the product of anyone other than Excursiv.

You also agree not to use any unauthorized automated program, bot, scraper, or spider to scan, copy, index, sort, or otherwise exploit our Services or Platforms or the data they contain. Excursiv invests substantial time and resources into curating, comparing, and presenting travel experience data from an expanding network of Providers, and any breach of this provision is treated as a material breach of these Terms. We reserve the right to take technical or legal action to detect and restrict unauthorized automated access.

Where you sign up for an account, you are responsible for keeping your login and password confidential and secure. If you become aware or suspect that the security of your account has been compromised, notify us immediately at hello@excursiv.com.

Our Services and Platforms are not intended for individuals under 16 years of age, and no one under 16 may provide information to or via our Services or Platforms. We do not knowingly collect personal information from anyone under 16, and if we learn we have received such information, we will delete it in accordance with our Privacy Policy.

To the extent any part of our Services or Platforms is hosted on or through a third-party platform (for example, a social media platform), and separate terms of use apply to that platform, you agree to comply with those terms in addition to these Terms.

Sharing information with us

We take your privacy seriously and operate in accordance with applicable data protection laws. You acknowledge that any personal data you submit to or via our Services or Platforms may be used by us in accordance with our Privacy Policy. You agree to ensure that all personal data you provide is accurate and up to date, and that you have all necessary consents, licenses, or approvals to allow us to use that information as described in these Terms and our Privacy Policy.

If you provide us with suggestions, comments, improvements, ideas, or other feedback about our Services or Platforms ("Feedback"), you irrevocably assign to us all intellectual property rights in that Feedback, and you acknowledge that we may use and share it for any purpose at our discretion, without any obligation to compensate you.

What Excursiv is, and is not

What we are

Excursiv is an independent experience discovery and comparison platform. Structurally, this is comparable to a travel meta-search platform of the kind used for flight comparison, except that Excursiv compares travel experiences across an expanding network of Providers rather than a fixed set. Current experience categories include Stays, Gastronomy & Dining, Concierge, Wellness Retreats, Adventure, Nightlife, Culture & Arts, Sports, Music & Festivals, Maritime Escapes, Wildlife & Nature, Fashion, and Pilgrimage. This list may expand or change over time as new categories are introduced, without requiring an amendment to these Terms for each addition.

What we are not

Excursiv is not a travel agency, tour operator, or event organizer. We are not a hotel, restaurant, venue, or activity operator. We are not a party to any booking made through a Provider. We are not a payment processor, merchant of record, or holder of any funds relating to a booking. We are not an insurer, guarantor, or warrantor of any Provider's performance, safety practices, or booking terms.

Our role

Our role is limited to aggregating and curating information about listings sourced from Providers, presenting comparative information, such as price and cancellation terms, where multiple Providers offer comparable listings, and directing you, via hyperlink, to the relevant Provider's own website or platform to view full details and complete any booking. Once you click a link to a Provider, you leave the Services, and your interaction is governed entirely by that Provider's own terms of service, privacy policy, cancellation policy, and pricing, not by these Terms.

Making bookings via Excursiv

Excursiv is not a travel agent and is not responsible for providing any travel option displayed via the Services, or for setting or controlling the prices we display. Any Third-Party Travel Product you find or book via our Services is provided by an independent Provider.

Excursiv facilitates your discovery of, and redirect to, a Provider's booking flow, but is not responsible for, and has no liability in respect of, the resulting booking. The identity of the relevant Provider, and the terms and conditions applicable to your booking with them ("Provider Terms"), will typically be presented to you on the Provider's own site before you complete a booking, and you should read and understand them fully before doing so.

The Provider Terms will set out what rights you have against the Provider and will explain the Provider's liability to you if something goes wrong. You agree to comply fully with all applicable Provider Terms. You acknowledge that breaching Provider Terms could result in the cancellation of a booking, forfeiture of any loyalty benefits, and additional charges imposed by the Provider.

Linked Travel Arrangements

Where you use our Services to book two or more related travel products, for example a stay and an activity, within a short period of one another, this may be classified as a "Linked Travel Arrangement" or comparable regulatory category, depending on your location and the consumer protection laws that apply there, including under the EU Package Travel Directive (Directive (EU) 2015/2302) and equivalent implementing legislation in EU member states and the UK.

Where a Linked Travel Arrangement is created through separate bookings with separate Providers via our Services, you generally will not receive the same level of consumer protection you would receive if you booked a combined package through a single organizer. This means you must rely on each individual Provider to perform its own obligations, and you generally will not have legal recourse against Excursiv as an organizer or retailer of a package, because Excursiv does not act, and does not intend to act, as a package organizer under applicable law. In the event of the insolvency of a Provider involved in a Linked Travel Arrangement created through our Services, insolvency protections available under the EU Package Travel Regulations or equivalent local law will generally not apply to that arrangement, because Excursiv has not assembled or sold you a package in the sense defined by that legislation. If you are uncertain whether a specific set of bookings you are making through our Services could constitute a package or Linked Travel Arrangement under the law of your jurisdiction, and what protections that would or would not carry, we recommend seeking independent advice before booking, or contacting the relevant Provider directly.

Price accuracy and warranty disclaimer

Your use of the Services and Platforms is entirely at your own risk.

Although we make reasonable efforts to ensure that listing content displayed on or via our Services is accurate and up to date, sourced from a combination of Provider data feeds, Provider public materials, and independent curation, we cannot guarantee the reliability, accuracy, or currency of that content. The Provider's own site is the authoritative source of current pricing and availability, and final terms are confirmed only at the point of booking on the Provider's platform.

We provide the Services and Platforms on an "as is" and "as available" basis, and expressly disclaim all warranties, conditions, and guarantees of any kind, whether express or implied, including but not limited to implied warranties of title, non-infringement, merchantability, fitness for a particular purpose, and accuracy, and any warranties implied by usage of trade, course of dealing, or course of performance. To the extent permitted by law, we make no representation and give no warranty that our Services or Platforms are accurate, complete, or up to date, will always be available, will meet your expectations, or are secure or free from errors, faults, defects, viruses, or malware.

Imagery

Where official Provider imagery is unavailable to us, Excursiv may, at this early stage of the platform's development, use independently sourced, appropriately licensed imagery, whether from licensed stock libraries such as Pexels or Unsplash, or from photography or videography we commission, purchase, or otherwise license directly, to represent the general character, setting, or location associated with a listing. Where such imagery does not depict the specific, exact venue, room, vessel, or facility involved, listing copy is written to reflect the general setting or experience, rather than assert a specific, unverifiable detail, and such imagery is not presented as an official photograph of the Provider or venue in question.

This is a transitional practice tied to Excursiv's pre-affiliate, early-stage curation process. As affiliate integrations with Providers are established and official Provider imagery becomes available through those integrations, Excursiv intends to phase out the use of general representative imagery in favor of accurate, Provider-sourced images for each listing. Where a listing has more than one available Provider, we intend to default to imagery sourced from the Provider presented as our top recommendation for that listing, where such imagery is available to us under our integration with that Provider.

Affiliate relationships and compensation

Excursiv participates in affiliate and referral marketing arrangements with Providers across our network. Full detail is set out in our Affiliate Disclosure, which is incorporated into these Terms by reference. In summary, Excursiv may earn a commission from a Provider when a user clicks through from the Services and completes a qualifying booking. This commission does not affect the price paid by the user, and this arrangement applies uniformly across our full Provider network, present and future, not solely the Providers named as illustrative examples elsewhere on the Platforms.

Accounts

To access certain features, such as saving or bookmarking listings, you may create an account via our Supabase-based authentication system, providing a valid email address and password. Your account currently supports saving and bookmarking listings only; it does not support booking, payment, or reservation functionality, which occurs entirely on the relevant Provider's own platform. If we introduce AI-assisted trip planning tools in the future, your account may also support saving itineraries or trip plans generated through those tools; any such itinerary remains a curated set of independent Provider listings, and Section "Linked Travel Arrangements" above applies to any resulting bookings in the same way it applies to bookings made independently. We reserve the right to suspend or terminate your account for violation of these Terms, suspected fraudulent activity, or as required by law. You may delete your account at any time directly within your account settings, or by contacting hello@excursiv.com.

21regents.com membership tier

21regents.com operates as an elevated membership sub-brand of Excursiv. Where membership involves curated access, early availability, or concierge-style recommendations, the relationship described above applies identically: Excursiv facilitates discovery and comparison, and, where applicable, curated recommendation; bookings remain direct contracts between the member and the relevant Provider. Specific membership terms, tiers, and benefits, once membership functionality is live, will be published separately and will supplement, rather than replace, these Terms. In the event of a conflict between these Terms and specific membership terms, the specific membership terms govern solely with respect to membership-specific matters.

Excursiv's property

Except as set out elsewhere in these Terms, all intellectual property rights, including copyright, trademarks, business names, design rights, database rights, know-how, trade secrets, and rights of confidence in our Services and Platforms, together, "Intellectual Property Rights," are owned by or licensed to Excursiv. This includes our original curated descriptions, comparison methodology, and the compiled arrangement of listing data. By using the Services or Platforms, you do not acquire any right, title, or interest in them, except for the limited license granted to you under these Terms. You have no right to access any part of the Services or Platforms in source-code form unless it is released under a license specifically permitting that access.

Other people's property

We respect the intellectual property rights of others. Provider names, logos, and listing details remain the property of the respective Provider. Imagery sourced from licensed stock platforms remains the property of the respective photographer or licensor and is used under the terms of the applicable license.

If you believe your copyright or other intellectual property right is being infringed by content on our Services or Platforms, please submit a written notice to hello@excursiv.com, including:

identification of the work claimed to be infringed;
identification of the allegedly infringing material and enough information for us to reasonably locate it on the Services, a URL is generally sufficient;
your contact information, such as an address, telephone number, and email address;
a statement that you have a good-faith belief the disputed use is not authorized by the rights holder, its agent, or the law;
for claims under the U.S. Digital Millennium Copyright Act, a statement, made under penalty of perjury, that the information in your notification is accurate and that you are the rights holder or authorized to act on their behalf, together with your physical or electronic signature.

We will review and, where warranted, remove or disable access to the allegedly infringing material in accordance with applicable law.

Illegal content

Excursiv is primarily a curation and comparison platform. Most content on our Platforms is listing information sourced from Providers, together with independently written curated descriptions and independently licensed imagery. We will act promptly on reports of content that is illegal or harmful, including illegal hate speech, discriminatory content, fraud, or intellectual property infringement. If you know of or reasonably suspect illegal content on our Platforms, contact us at hello@excursiv.com.

Limitations and exclusions of liability

These Terms set out the full extent of Excursiv's obligations and liabilities in respect of our Services and Platforms.

Excursiv has no responsibility for any arrangement you make with a Provider as a result of your use of our Services or Platforms. If you encounter a problem with a booking you make or attempt to make via a Provider, you acknowledge that you should resolve that issue with the Provider directly, and that your sole remedy, including any refund, lies with the Provider and not with Excursiv. Where our Services or Platforms link to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the content of those sites and accept no responsibility for them, or for any loss or damage that may arise from your use of them.

To the maximum extent permitted by law, we, together with our officers, employees, representatives, and any future affiliates, do not accept liability for (a) any inaccuracy or omission in the content displayed on or via our Services or Platforms, or (b) any act of God, accident, delay, or any special, exemplary, punitive, indirect, incidental, or consequential loss or damage of any kind, including but not limited to lost profits or savings, whether based in contract, tort, including negligence, strict liability, or otherwise, arising out of or in connection with your access to, use of, or inability to access or use, our Services or Platforms or their content.

Subject to these Terms and to the extent permitted by law, our maximum aggregate liability to you arising out of or in connection with these Terms, or your access to, use of, or inability to access or use, our Services or Platforms, is limited to the greater of (a) the total commission, if any, actually received by Excursiv from the Provider in connection with the specific booking giving rise to the claim, which will commonly be zero, since no user payment flows through Excursiv, or (b) one hundred United States dollars (USD $100).

Nothing in these Terms limits or excludes (a) our liability for death or personal injury caused by our own negligence or for our fraud or fraudulent misrepresentation, in our capacity as an information and comparison platform, as distinct from, and expressly excluding, the conduct, negligence, or performance of any Provider, for which Excursiv bears no responsibility, (b) any other liability that cannot be excluded by law, or (c) your statutory rights as a consumer under the law of your jurisdiction.

Your liability to us

Subject to these Terms, you are responsible and liable to us for all actions, claims, proceedings, costs, damages, losses, and expenses, including reasonable legal fees, incurred by us and our officers, employees, and agents, arising out of or connected with your use of our Services or Platforms, or your breach of these Terms, except to the extent such claims arise from our own gross negligence or willful misconduct.

Termination

We may, at our discretion, terminate any agreement with you under these Terms at any time on notice to you, and, if you have an account, by canceling your account and access to it, and removing any content you have uploaded to the Services or Platforms. We may suspend your access, in whole or in part, without notice, at any time, for example to prevent misuse of the Services, without incurring any liability to you.

Dispute resolution

Informal resolution first

Before initiating any formal dispute resolution process, you agree to first contact us at hello@excursiv.com and attempt to resolve the dispute informally for at least 30 days.

Governing law and venue

Irrespective of the country from which you access or use the Services or Platforms, to the extent permitted by law, these Terms and your use of the Services will be governed by the laws of India, and you are deemed to have submitted to the non-exclusive jurisdiction of the courts of Mumbai, Maharashtra, India, to resolve any dispute arising under these Terms, except where mandatory local consumer protection law grants you the right to bring proceedings in your own jurisdiction of residence, in which case that right is preserved.

Arbitration

Where not prohibited by mandatory local consumer protection law, you and Excursiv agree that any dispute not resolved informally under this section shall be resolved by binding arbitration rather than in court, except that either party may bring an individual claim in small claims court where that court has jurisdiction. You and Excursiv agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding, to the extent such a waiver is enforceable in your jurisdiction. You may opt out of this arbitration provision by sending written notice to hello@excursiv.com within 30 days of first accepting these Terms, clearly stating your intent to opt out. Where mandatory consumer protection law in your jurisdiction prohibits mandatory arbitration or class action waivers for consumer disputes, this arbitration provision applies only to the extent permitted by that law, and the courts identified above otherwise have jurisdiction.

General provisions

You acknowledge that your unauthorized use of our Services or Platforms may cause harm to Excursiv for which monetary damages would be inadequate, and that, in such cases, we have the right, in addition to any other legal remedy, to seek an immediate injunction against you.

The invalidity or unenforceability of any provision of these Terms, in whole or part, does not affect the validity or enforceability of the remaining provisions. Any provision held invalid or unenforceable by a court of competent jurisdiction is deemed deleted from these Terms.

These Terms are personal to you. You may not assign them, in whole or part, to any third party without our prior written consent. We may assign these Terms without restriction, including in connection with a sale of assets, merger, acquisition, or upon incorporation of the business.

These Terms, together with our Privacy Policy, Cookie Policy, and Affiliate Disclosure, represent the entire agreement between you and Excursiv, and supersede any previous terms, conditions, or arrangements regarding your use of the Services or Platforms.

Our failure to enforce any of these Terms is not a waiver of that provision, and does not limit our right to enforce it subsequently.

A person who is not a party to these Terms has no right to enforce any provision of them.

Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship between you and Excursiv, or between Excursiv and any Provider.

These Terms are entered into on behalf of a sole proprietorship operating from India, which is not yet a formally incorporated company. Upon incorporation, this section will be updated to name the incorporated entity, and continued use of the Services or Platforms after that update constitutes your acceptance of the change.
